On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the judgment of the Court of Appeals. There was no unauthorized presence in the jury room. Further, the trial court correctly communicated to the jury that there was no transcript in evidence. The assumption by the Court of Appeals that the jury may have been seeking something else was not adequately supported by the record. We REMAND this matter to the Court of Appeals for resolution of issues raised but not addressed. Archer, J., would not dispose of this case by peremptory order but would instead either grant or deny leave to appeal.
